You'll use Internal Revenue Service Form 2553 to elect S-corporation treatment. After the IRS processes your request, you will receive a letter that confirms your elected status. If you previously received your acceptance letter, but have lost it or need a replacement, or if you have submitted Form 2553 and have not received your letter, you can contact the IRS directly to request it.
Gather documents to prove you sent your S-corporation election to the IRS. These may include a certified mail receipt or fax confirmation page.
Note the date on your proof. In most cases, the IRS may take up to two months to process Form 2553. If you need a copy of your initial letter, rather than a replacement copy, you must wait at least two months before you contact the IRS for your letter. For certain fiscal-year selection requests, you may have to wait at least five months for your initial acceptance letter.
Call the IRS at 800-829-4933 between 7 a.m. and 10 p.m., local time. This reaches the IRS business division. Listen to the prompts and enter your business EIN number. From the next menu, select the option to speak with a representative.
Answer verification questions about your business. The agent who takes your call must confirm the correct record is being researched and that you’re authorized to receive information about the company. You’ll need the business name, EIN number and address to answer some of the questions. You may also need to confirm the type of income tax form the company usually files.
Request your acceptance letter. If you’re requesting the initial acceptance letter, the agent will check the computer system to see if your request has been received by the IRS. If it has, the agent will give you an estimated date that your letter will be sent.
Upload a scanned copy of your acceptance letter to your client portal. We will need this to prepare your first S-corporate tax return!
